Q: What is historic preservation easement?
A: A preservation easement is a legal agreement between a property owner and a qualified preservation organization, such as The Palmetto Trust for Historic Preservation (PTHP). The donation of a preservation easement gives PTHP a partial interest in the property, insuring that it will be protected from inappropriate development or demolition. The owner maintains private ownership and all the rights and duties of ownership, except the right to alter the portions of the property protected by the preservation easement. Easements are flexible tools, and each easement is tailored to suit the needs of the property and the owner. Historic preservation easements are intended to protect the historic resources on the property. These can include only the exterior of the building, or can be extended to elements of the building's interior and to the landscape surrounding the building. Federal and state tax credits make preservation easements very desirable to many property owners. Read more about easements or view a sample preservation easement.
